An Giang in the era of e-commerce law: Opportunities, challenges, and adaptability

On December 11, 2025, in An Giang province, the Department of E-commerce and Digital Economy, Ministry of Industry and Trade, in coordination with the Department of Industry and Trade of An Giang province, organized a training conference to enhance the capacity for applying and developing e-commerce for businesses and state management officials in the province.

The conference was organized to enhance management capacity in the context of the ongoing digital transformation, while supporting businesses and production and trading establishments in An Giang to access and effectively apply e-commerce, digital technology, and new tools, thereby gradually expanding markets, improving competitiveness, and moving towards sustainable development.

 

E-commerce: From Local Practices to Global Trends

From an international perspective, Mr. Tuan stated that global e-commerce retail sales are projected to reach approximately US$6.86 trillion in 2025, with a growth rate of 8.3%. China currently accounts for about 44% of the global e-commerce retail market share, followed by the United States with approximately 16%. Notably, Southeast Asia, including Indonesia, Vietnam, and Thailand, is emerging as the fastest-growing region in the world, thanks to its young population, high internet penetration rate, and the boom in digital platforms.

Key trends in global e-commerce

According to Mr. Tuan's analysis, the prominent trends in global e-commerce during 2024–2025 include the strong increase in mobile shopping, with M-commerce transactions accounting for nearly three-quarters of total e-commerce transactions; the increasingly widespread application of artificial intelligence in product search, recommendation, and personalization of shopping experiences; and the strong development of livestreaming sales, social commerce, cross-border e-commerce, and omnichannel retail models. These trends are fundamentally changing how consumers access and make purchasing decisions.

Regarding Vietnam, Mr. Nguyen Huu Tuan stated that the e-commerce market size in 2024 reached approximately US$25 billion, with a growth rate of over 25%, placing Vietnam among the top 10 fastest-growing e-commerce countries in the world and leading the Southeast Asian region. In terms of scale, Vietnam currently ranks third in the region, after Indonesia and Thailand. It is projected that by 2025, Vietnam's e-commerce market will surpass US$30 billion, accounting for approximately 10% of the country's total retail sales of goods and consumer services. Average per capita e-commerce spending is expected to reach approximately US$400 per year, with about 55% of the population participating in online shopping. Sectors experiencing high growth include fast-moving consumer goods, household appliances and technology, and fashion.

In this context, Mr. Tuan also pointed out many new online business trends and models that are emerging and developing strongly in Vietnam, such as the sharing economy, online tourism, dropshipping, and direct sales from businesses to consumers. In particular, the trend of consumers, especially Generation Z, tending to access entertainment content before making purchasing decisions has strongly boosted forms such as livestreaming sales, interactive shopping videos, and gamification activities in e-commerce.

Besides analyzing market trends, Mr. Nguyen Huu Tuan also particularly emphasized legal content at the conference. According to Mr. Tuan, with the rapid development of e-commerce, the need to improve the legal framework to manage, regulate, and protect the rights of participating parties is becoming increasingly urgent. The legal responsibilities of entities participating in e-commerce activities, especially website owners and intermediary platforms, need to be fully understood and seriously implemented.

Mr. Tuan stated that, according to current regulations, owners of e-commerce websites are responsible for fully and accurately disclosing information related to their business, including name, address, business registration information, and contact methods. In addition, information about goods and services must be clearly and truthfully presented, ensuring compliance with regulations on product labeling, origin, quality, and pricing. This includes clearly stating whether the price includes or excludes taxes, shipping fees, and other incidental costs. The website must also publish general terms and conditions of transaction, including policies on product inspection, returns, warranties, and complaint resolution mechanisms, and ensure that customers individually agree to these terms and conditions before entering into a contract.

Failure to disclose, or the disclosure of incomplete or inaccurate, required information can lead to administrative penalties, with fines varying depending on the nature and severity of the violation. Therefore, Mr. Tuan emphasized that businesses need to proactively review and improve the legal content on their websites and sales platforms to mitigate risks and ensure transparent business operations and compliance with the law.

New E-commerce Law: The legal foundation for e-commerce in An Giang

Regarding the new legal framework, Mr. Nguyen Huu Tuan stated that the National Assembly officially passed the Law on E-commerce on December 10th, with very high consensus. The law, comprising 7 chapters and 41 articles, will take effect from July 1st, 2026, and is expected to create a comprehensive, modern legal framework suitable for the development of e-commerce and the digital economy in the new era.

According to Mr. Tuan, the new E-commerce Law has clarified the responsibilities of entities participating in e-commerce activities, especially for business activities on social media and livestreaming sales, thereby enhancing information transparency and protecting consumer rights. The law also adds regulations on identifying sellers on e-commerce platforms linked to the national electronic identification system, aiming to clean up the market, limit counterfeit goods and goods infringing intellectual property rights, and effectively support tax management and combat revenue loss for the state budget. In addition, regulations related to the responsibilities of foreign e-commerce platforms operating in Vietnam have also been improved, ensuring compliance with international commitments and enhancing the effectiveness of state management.

Mr. Nguyen Huu Tuan expressed his hope that businesses and state management agencies in An Giang province would soon access, study, and fully understand the new regulations of the E-commerce Law, thereby proactively adjusting their management, production, and business activities to conform with the new legal framework. Mr. Tuan emphasized that correctly understanding and implementing the Law will not only help businesses mitigate legal risks but also contribute to building a transparent and healthy e-commerce environment, creating a foundation for the sustainable and in-depth development of e-commerce in An Giang in the future.

Professionalizing business operations in the digital environment.

Within the framework of the Conference, Mr. Cao Qui Long – lecturer at the Center for E-commerce and Digital Technology Development (eComDX) – presented training content related to the application of digital technology and artificial intelligence in practical management and production and business operations. The training focused on equipping officials, civil servants, and businesses with the knowledge and skills to apply digital technology to management, monitoring, and task implementation, thereby improving operational efficiency and organization in the context of digital transformation.

At the same time, manufacturing facilities and businesses in An Giang province are also guided to utilize artificial intelligence tools to create short videos promoting their products, contributing to improved market access, increased communication effectiveness, and gradually professionalizing business operations in the digital environment.

Through the conference, businesses and state management officials in An Giang have more opportunities to directly exchange ideas with experts, resolving difficulties and obstacles in the process of implementing e-commerce and digital transformation. This is considered an important prerequisite contributing to promoting the application of e-commerce, developing the digital economy, and enhancing the competitiveness of businesses in the province in the coming time.
